What is Premises Liability?
Premises liability is a legal concept that holds property owners and managers responsible for injuries that occur on their properties. Under Hawaii law, property owners and managers have a duty to maintain reasonably safe premises. This means that they must take certain precautions to ensure that their properties are free from hazards and that visitors will not be injured while on the premises.
There are three main types of visitors under Hawaii premises liability law:
- Invitees: These are individuals who are invited onto the property for the benefit of the property owner. Examples include customers at a store or restaurant.
- Licensees: These are individuals who are invited onto the property for their own benefit. Examples include social guests.
- Trespassers: These are individuals who are on the property without permission. Property owners and managers generally do not owe a duty of care to trespassers, with a few exceptions.
Property owners and managers owe the highest duty of care to invitees. They must take reasonable steps to ensure that the property is safe and that invitees will not be injured while on the premises. This includes regularly inspecting the property for hazards, repairing any known hazards in a timely manner, and warning invitees of any known hazards that cannot be immediately repaired.
Property owners and managers owe a slightly lower duty of care to licensees. They must still take reasonable steps to ensure that the property is safe, but they are not required to regularly inspect the property for hazards. Instead, they must only repair known hazards in a reasonable amount of time and warn licensees of any known hazards.
As mentioned, property owners and managers generally do not owe a duty of care to trespassers. However, if a property owner or manager knows that trespassers are likely to enter the property, they must take reasonable steps to warn them of any known hazards that could cause serious injury or death.
